RETURNS POLICY

 

1. Buyer's right to claim defective goods
If there is a defect in the purchased goods, the buyer is entitled to exercise the rights of liability for defects in the goods (to make a claim). The store manager or an authorised employee is obliged to decide on the claim immediately after examination, in complicated cases within three days. This time limit does not include the time required for a professional assessment of the defect.

The customer may deliver the claimed goods to the address of WARAGOD s.r.o. Murgašova 2, 94901 Nitra. However, the processing may not take longer than 30 (thirty) days. The Buyer is not entitled to claim defects for which a discount has been granted and of which the Seller has informed the Buyer. 


2. Liability of the Seller
When selling goods to members of the public, the Seller shall be liable for ensuring that the goods are of the required quality, quantity, measure and weight. They must be free from defects and conform to technical standards. The seller shall be liable for defects in the goods sold upon receipt of the goods and for defects that occur after receipt of the goods within the guarantee period. In the case of second-hand goods, the Seller shall not be liable for defects caused by use, wear and tear or improper handling.

 

3. Place of complaint
The Buyer shall make the claim in the shop where the goods were purchased. For the purposes of purchase via the Internet, the shop is WARAGOD s.r.o., Murgašova 2, 94901 Nitra. The Buyer shall prove the purchase with the relevant proof of purchase and, if the product is a product with an extended warranty period, also with a confirmed warranty certificate. In the event of temporary closure or closure of the establishment, the claim shall be made at the establishment which is indicated on the notice of temporary closure or closure of the establishment.

4. Warranty period
The acceptance of a claim is subject to the condition that it is made within the guarantee period. The warranty period is 24 (twenty-four) months from the date of receipt of the goods by the buyer. If the goods have a longer warranty period, the Seller is obliged to issue the Buyer with a duly completed and certified warranty certificate at the time of sale, which specifies the terms and scope of this warranty. If the Buyer's claim is settled by replacing the defective goods with faultless goods, the warranty period shall apply to the new product from the date of receipt of the new goods. The same shall apply if a part or component for which a warranty has been provided is replaced. 

5. Cancellation of order
An order may only be cancelled before the order has been registered or dispatched. If the order has already been packed and dispatched the order cannot be cancelled and the customer is obliged to collect it according to the terms and conditions.

6. Correctable errors
Reparable defects are defects in the goods, the removal of which will not impair the appearance, function and quality of the goods. If they are avoidable defects, the buyer may demand:
(a) free, proper and timely rectification of the defects
(b) replacement of the defective part or component, if the defects relate only to the part or component
(c) replacement of the goods if they have not yet been used

7. Irremediable defects
If there are irremediable defects which prevent the goods from being used properly, the buyer may demand the replacement of the defective goods with faultless goods. If replacement of the defective goods by the seller is not possible, the buyer may demand cancellation of the contract and a refund of the amount paid.

8. Settlement of the complaint by granting a discount
If the buyer asks for a discount, the complaint can be settled by granting a discount. A discount on the goods is granted if there are irremediable defects which do not prevent the goods from being used properly for their intended purpose. In determining the amount of the discount, the extent of the defects of the goods complained of shall be taken into account.

9. Unjustified trip to the complaint
In the event of an unjustified trip to a claim, the Seller has the right to charge the Buyer a fee in the amount of the costs associated with the trip. The Seller also reserves the right not to refund such goods and not to exchange them for other goods.

10. Withdrawal from the contract and exchange of goods

Withdrawal from the contract, i.e. the return of the goods with a refund of the purchase price, is accepted within 14 days of receipt of the goods by the buyer. The time limit for the exchange of goods is 30 days from the receipt of the shipment by the buyer. In case of exchange, the buyer shall choose goods of equal or higher value. In case of difference, the amount of the difference will be calculated by cash on delivery.
