INFORMATION WITH THE PROCESSING OF PERSONAL DATA.

1. GENERAL INFORMATION ON THE PROCESSING OF PERSONAL DATA ("PDP").

We comply with the rules and therefore the protection of your PI is important to us. We process PI in accordance with these terms and conditions.

By giving your consent to the processing of your Personal Data on the portal www.waragod.sk, you give your consent in the form of a serious and freely given, specific, informed and unambiguous expression of the data subject's (buyer's) will in the form of an unambiguously confirmatory act within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27. April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and also according to the provisions of Act No. 18/2018 Coll., of 29 November 2017 on the protection of personal data and on amending and supplementing certain acts, as amended, to the operator (hereinafter referred to as the "GDPR and the ACT").

2. PURPOSE OF THE PROCESSING OF THE OU
If you have provided us with OU, it will be used for the following purposes:

2.1 E-shop - for the conclusion and performance of the purchase contract, payment processing, delivery of the product or performance of other related activities (such as complaints and other obligations related to consumer protection legislation), concluded via www.waragod.sk between the operator and the buyer. To process your order, you have provided us with your name, surname, address, e-mail address, telephone number and your payment details. E-mail and telephone contact also serve as a means of communication.

An order confirmation will be sent to your e-mail address, and you can also track the status of your order.

We process personal data on a legal basis (Art. 6 /1/b GDPR and LAW) The processing of personal data is necessary for the performance of a contract to which the data subject (buyer) is a party or for the performance of a pre-contractual measure at the request of the data subject (buyer) (point 2. 1), i.e. it is a contractual requirement.

2.2 Marketing - for marketing purposes if you have given your consent to the controller by clicking opt in. Marketing purposes are understood as sales promotion, marketing offers, newsletters, product and news information or, for example, an email with a name day discount coupon. If the customer does not wish to receive these offers, they simply unsubscribe using the opt-out form. 

The controller processes the OU on the basis of the data subject's consent (Art. 6/1/a GDPR and LAW).

3. REGISTRATION
The Buyer has the opportunity to register at www.waragod.sk. The buyer is allowed to buy without registration.

If you choose to purchase through registration, we will process your PI as follows:

You protect your account with a password. By logging in to your account, you will receive information about your orders, you can edit your POs, such as setting up a newsletter. Please protect your password, the operator is not responsible for password misuse.

By creating an account on www.waragod.sk that the OU in your account will be evaluated and collected for the purpose of using the services. By creating this account, you also give us permission to evaluate and your purchasing behavior, that is, what products you have purchased, which products you have viewed.

If you have registered, you agree that your user behavior on www.waragod.sk will be associated with your customer account so that we can provide you with this personalized content (e.g., special promotions and information).

If, however, you have changed your mind and no longer wish to be registered, you may request deletion of your account at any time using the customer support contact form. You can also shop on waragod.sk at any time as a non-registered buyer, i.e. as a guest.

4. THIRD PARTIES
Your personal data may be disclosed to third parties. During the processing of the order and the execution of the purchase contract, data is also provided to third parties such as carriers, couriers, banks, etc. The buyer's personal data is processed only for the purpose of fulfilling the contract and for the necessary time specified in paragraph 6 Processing time.

5. UNDER 16 YEARS OF AGE
In connection with the offer of information society services, the controller processes personal data on the basis of the data subject's consent lawfully, if the data subject has reached the age of 16. This e-shop is not directly addressed to persons under the age of 16.

The controller does not process the personal data of persons under the age of 16. For each registration/login, the operator asks for an affidavit from the buyer. This e-shop is not intended for purchases by under 16s.

6 PROCESSING PERIOD
The buyer agrees to the processing of personal data from the date of granting in accordance with these terms and conditions for a period of up to 10 years in fulfillment of the purpose of performance from the contract paragraph 2.1.

The Buyer consents to the processing of personal data from the date of grant in accordance with these terms and conditions for a period of up to 3 years in fulfillment of the purpose of marketing activities paragraph 2.2.

7. TRANSFER TO A THIRD COUNTRY
The controller intends to transfer the PII to a third country or international organisation, including the identification of the country or international organisation. 

The controller uses Mailchimp, which is based in the USA. 

The US is a country that guarantees adequate protection under the European Commission's decision. The operator of the Mailchipm online application has provided adequate safeguards and security for the PI and warrants that it processes the PI in accordance with the principles of the GDPR. 

  

8. AUTOMATED PROFILING
The controller processes PI in paper and electronic form.

In order to improve the quality of marketing campaigns, the controller uses automated profiling. By profiling, we segment the offer(s) that may be of interest to you and are more profitable for you. In the case of profiling, we use the following systems Google Adwords, Facebook, Sklik, Etarget....

Consent is not required for basic statistical data collection, e.g. using the Google Analytics measurement code.

9. IP ADDRESS  
Is a set of numbers uniquely identifying a device on a computer network.

An IP address can be regarded as data relating to an identifiable person from a data protection perspective.

An IP address becomes personal data if:

The IP address is personal data if it is processed by the ISP together with another identification (name, email...).
Static IP addresses used by natural persons/individuals are to be considered as personal data.
A dynamic IP address will be considered as personal data if other identifiers considered as personal data (e.g. first name, last name, email, etc.) are processed by the online service provider together with the dynamic IP address.
In the case of storing the IP address on a website (e.g. the CreativeSites editorial system for comments), it is necessary to choose an appropriate processing purpose or to use pseudonymisation.

10.  SECURE DATA TRANSFER
Your personal data is transmitted securely thanks to encryption. The SSL (Secure Socket Layer) encryption system is most commonly used for secure communication with web servers. The personal data in our systems as well as the website are secured by appropriate technical and organisational measures against loss, destruction, alteration and further dissemination of data by unauthorised persons.

If you are registered on our website www.waragod.sk, only you have access to your account, so please take care to treat this data confidentially. The operator is not liable for unauthorized handling or misuse of the password.

11. RIGHTS OF THE AFFECTED PERSON (Buyer)
The Buyer has the right under the GDPR to (i) the right to rectification, (ii) the right to erasure, (iii) the right to data portability, (iv) the right to object, (v) the right to withdraw consent, (vi) the right of access to information.

Right to rectification.
The Buyer has the right to have the Controller correct incorrect PII relating to him/her and to complete incomplete PII without undue delay.

Right to erasure.

The Buyer has the right to have the Operator delete the OUs relating to it without undue delay. The Operator shall delete such PI without undue delay if any of the following reasons are met:

The PII is no longer necessary for the purpose for which it was obtained or processed,
the data subject withdraws consent to the processing of the PII for at least 1 specific purpose, or the consent is invalid if its provision is precluded by a specific regulation,
the data subject objects to the processing of personal data pursuant to and no legitimate grounds for the processing of personal data prevail or the data subject objects to the processing of personal data pursuant to this concerns direct marketing, including profiling,  
the processing of the Personal Data is unlawful,
the ground for erasure is the fulfilment of an obligation under this Act, a special regulation or an international treaty to which the Slovak Republic is bound, or
the data subject is under the age of 16 years and the data subject has collected the personal data in connection with the offer of information society services.
If the controller has disclosed the PII and is obliged to erase it, he shall also take appropriate security measures, including technical measures, taking into account the available technology and the costs of implementing them, in order to inform other controllers who process the data subject's PII of his request that those controllers erase references to his PII and copies or copies thereof or copies thereof.

Right to data portability.
The Buyer has the right to obtain the PII concerning him/her that he/she has provided to the Data Controller in a structured, commonly used and machine-readable format and has the right to transfer this PII to another Data Controller - the Seller, if technically feasible and if:

the data subject's consent, the contract and the data subject's consent are processed, which is invalid if its provision is excluded by a specific regulation,
the processing of PI is carried out by automated means.

Right to object
The purchaser has the right to object to the processing of PI concerning him or her for the purpose of direct marketing, including profiling to the extent that it is related to direct marketing, the controller must explicitly inform the data subject of his or her rights at the latest at the time of the first communication with him or her, and the information about this right must be clearly and separately from any other information. The purchaser may exercise his right to object by automated means using technical specifications.

Withdrawal of consent
The buyer has the right to withdraw consent to the processing of personal data concerning her at any time. Withdrawal of consent shall not affect the lawfulness of the processing of personal data based on consent prior to its withdrawal; the Buyer must be informed of this fact before consent is given. The buyer may withdraw consent in the same way as he or she gave consent.

Right of access to information.
The Buyer has the right to obtain confirmation from the Controller as to whether PI relating to her is being processed. If the controller processes such PII, the buyer has the right to access and obtain information about that PII:

the purpose of the processing of OU,
the category of the PII processed - in our case, it is ordinary PII, the controller does not process a special category of PII.
the identification of the recipient or the category of recipient to whom the PII has been or is to be disclosed, in particular a recipient in a third country or an international organisation, if applicable,
the period of retention of the PSI; if this is not possible, information on the criteria for its determination,
the right to request from the controller the rectification, erasure or restriction of the processing of data relating to the purchaser or the right to object to the processing of data relating to the purchaser,
the right to bring an action,
the source of the PII if the personal data was not obtained from the purchaser,
the existence of automated individual decision-making, including profiling in these cases, the controller shall provide the purchaser with information, in particular on the procedure used as well as on the significance and foreseeable consequences of such processing of personal data for the purchaser.
The controller is obliged to provide the information on the basis of this request within 30 days of receipt of this request. This period may be extended by the controller for a further 60 days; we will inform you of any postponement.

The Operator may charge a reasonable fee corresponding to the administrative costs for the repeated provision of the OU requested by the Purchaser. The Operator shall provide the Buyer's OU in the manner requested by the Buyer or as requested by the Buyer.

The Operator reserves the right to verify the Buyer and to ascertain whether the Buyer is a specific Buyer. Verification consists in providing additional information, e.g. by means of control questions. Verification is important in terms of providing information about the PIs that the controller processes for the protection of personal data.

The right to bring an action by the purchaser.
The purchaser may file a petition to initiate proceedings under Section 100 of the Act if he is directly affected in his rights, the petition must include who is filing the petition, against whom the petition is directed with the subject matter of the petition with an indication of the rights that should have been violated in the processing of the personal data, evidence. 

A template of the petition will be published on the website of the Office for Personal Data Protection, Hraničná 12, 820 02 Bratislava.  The Authority shall consider the complaint within 30 days, decide within 90 days or may extend the time limit accordingly.

12. COOKIES
12.1 In accordance with § 55 (5) of Act No. 351/2011 Coll. on Electronic Communications, as amended, we would like to inform you about the use of cookies and draw your attention to the possibility of changing the settings of your internet browser in case the current setting of the use of cookies does not suit you.

This policy contains information on how the operator uses cookies and similar technologies ("cookies").

12.2 What are cookies?

Cookies are small text files that can be sent to your browser when you visit a website and stored on your device (computer or other internet-enabled device such as a smartphone or tablet). Cookies are stored in your browser's file folder. Cookies usually contain the name of the website from which they originate, their validity and value. The next time you visit the site, your web browser will reload the cookies and send this information back to the website that originally created the cookie. The cookies we use do not harm your computer.

12.3 Types of cookies. We use cookies in order to optimally create and continuously improve our services, to adapt them to your interests and needs and to improve their structure and content.

These cookies form the basis for the operation of our website and enable the use of basic functions such as secure areas or online payments. 14. FINAL PROVISIONS
This information comes into force and effect on 25.05.2018 The Operator reserves the right to change these terms and conditions in the event of a change in the processing of personal data in the company and in the event of a legislative change.
